Terms of Service

These Terms of Service ("Terms") govern your use of the Veltoria AI platform ("Service") operated by NxGen AI Labs ("we", "us", "our"). Veltoria is a product of NxGen AI Labs. By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Veltoria. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

  • You may register using email/password or through Google, Microsoft, GitHub, or Apple authentication.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information during registration.
  • One account per person. Do not share accounts or create multiple accounts to circumvent usage limits.

3. Acceptable Use

You agree to use Veltoria responsibly. You may not:

  • Use the Service to generate illegal, harmful, abusive, or hateful content.
  • Attempt to bypass rate limits, usage caps, or tier restrictions.
  • Reverse-engineer, scrape, or extract the underlying AI models or system prompts.
  • Use automated scripts or bots to interact with the Service without authorization.
  • Resell or redistribute access to the Service.
  • Upload malicious files, malware, or content that violates others' intellectual property rights.

4. Subscription Tiers and Billing

  • Free tier: Available at no cost with usage limits (150,000 tokens per month, 5,000 tokens per day, Lite model only, 7-day chat history).
  • Paid tiers (Pro, Pro+, Power): Available as monthly or annual subscriptions, billed through Stripe. Annual plans save up to 17%. Current prices are listed on our Pricing page.
  • Monthly subscriptions renew on the same calendar day each month. Annual subscriptions renew once per year.
  • You may cancel your subscription at any time from your account settings. Access continues through the end of the current billing period, after which your account reverts to the Free tier.
  • We reserve the right to change pricing with at least 30 days' written notice to active subscribers, effective at the next renewal.
  • Subscription fees are in U.S. dollars and exclude any applicable taxes, which are your responsibility.
  • If payment fails, your subscription enters a grace period. If the issue is not resolved, your account will be downgraded to the Free tier.

5. Refund Policy

Our refund and cancellation policy:

  • Subscriptions are non-refundable: All payments for Veltoria subscriptions, monthly or annual, are final and non-refundable except where required by applicable law.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation stops future billing. You retain access through the end of the billing period you have already paid for, after which your account reverts to the Free tier. We do not refund or prorate the unused portion of any subscription period.
  • Discretionary exceptions: We may, at our sole discretion, consider a refund in narrow circumstances such as an accidental duplicate charge or a subscription purchased and never used. Discretionary refunds are not a right and are not guaranteed. Contact support@veltoria.io.
  • No service credits: Veltoria does not offer service credits, refunds, or other compensation for service interruptions, outages, degraded performance, or unavailability of any feature, model, or third-party dependency. The Service is provided on an "as is" and "as available" basis.
  • Termination for cause: Accounts terminated for violations of these Terms, suspected fraud, abuse, or chargeback activity are not eligible for any refund.
  • Suspected abuse: We reserve the right to refuse any refund request and to suspend or terminate any account where we reasonably suspect refund abuse, fraudulent payment activity, or use of the Service inconsistent with normal individual use.

6. Your Content

  • You retain ownership of the content you create through Veltoria (prompts, uploads, generated outputs you choose to save).
  • We do not claim ownership of your conversations or generated content.
  • We do not use your conversations to train AI models (see our Privacy Policy for details).
  • Chat history is retained according to your subscription tier and then permanently deleted.

7. AI-Generated Content Disclaimer

AI-generated responses may contain inaccuracies, biases, or errors. Veltoria is a tool to assist you, not a substitute for professional advice (medical, legal, financial, or otherwise). You are responsible for verifying and using AI outputs appropriately. NxGen AI Labs is not liable for decisions made based on AI-generated content.

8. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service.
  • We may perform maintenance, updates, or modifications that temporarily affect availability.
  • We reserve the right to modify, suspend, or discontinue features with reasonable notice.

9. Account Termination

  • You may delete your account at any time from account settings.
  • We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, NxGen AI Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless NxGen AI Labs from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas and the United States, without giving effect to any principles of conflicts of law. Any disputes shall be resolved in the state or federal courts located in Potter County, Texas.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
